BREEDING CONTRACT

THIS AGREEMENT made and entered this day and month written below between Drake Johnson Reining Horses, Wray, Colorado (“Stud Manager”) and_____________________________________(Mare Owner).

 

These Parties agree as follows:

1.        Mare Owner agrees to breed the mare (“Name”):_______________________________________

Registration #____________Date Foaled________________ to ­­­­­­­­­­­­­­­­­­­­                       AQHA #               ­­­­­­­­­ (STALLION) standing at Drake Johnson Reining Horses, Wray, CO for the 2004 Breeding Season, and pay the breeding fee together with other reimbursable expenses herein.         

 

2.   The Stallion Service Fee for 2004 breeding season is $1500.00. If booked prior to 2/1/2004  $1,250.00. Booking fee is $500.00. The balance of the service fee is to be paid prior to service or shipment of semen. The booking fee is nonrefundable. The booking fee is included in the Stallion Service Fee. Mare must be picked up at the ranch immediately after receipt of pregnancy statement, unless prior arrangements have been made.

 

3.      Mare shall be in healthy and sound breeding condition, as certified by veterinary examination at  

Ranch upon arrival. Owner authorizes and agrees to pay for this examination.  Mare owner further agrees to promptly pay all veterinary expenses (i.e. worming, treating for infection, preventive measures, etc.) necessary to ensure well being of mare.

 

4.      All mares must be halter broke and gentle.

 

5.      Board, veterinary and other expenses must be paid monthly.  Any payments not received by the 10th of each month will be assessed a $50.00 late charge

 

6.      All board and other expenses must be paid in full before mare departs. Final payment must be made

in the form of Cash, Cashiers Check or Credit Card.

 

7.      Drake Johnson Reining Horses (DJRH) will care for mare and/or foal in a diligent manner, and reserves the right to employ veterinary care at owner’s expense in case of illness or injury.

 

8.      DJRH guarantees a live foal from this mating, meaning the foal shall stand and suck.  Should it not, the owner will be entitled to a return privilege for the same mare the following breeding season only.  There will be a charge of $300.00 for rebreeding expenses. This guarantee only applies if DJRH is notified within 48 hours of the foal’s death. Statement of details by a licensed veterinarian must follow within 10 days or guarantee will become invalid. This clause is also binding in case of abortion.

 

9.      The breeding season for this contract will begin February 1, 2004 and end July 1, 2004.

 

10.  Should the said stallion die, become unfit for service, or if the above named mare dies during the breeding season, then the owner may substitute another mare or breed the mare to another stallion on the ranch if agreed to by both parties. If the mare owner fails to deliver the Mare (or an agreed substitute as stated above) for rebreeding the following year, then any and all fees paid shall be nonrefundable and the right to rebreed is thereby cancelled and Stallion Owner is released from any further obligation.

11.  This contract is entered in the State of Colorado and will be interpreted and enforced under the laws of the State.

 

12.  Waiver of Liability. It is understood that the breeding farm, its owners, stallion owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of any horse on its premises. The above named Mare Owner, whose horse(s) are under the care of Drake Johnson Reining Horses, will not be liable or responsible for any damage, injury, or death to the breeding farm’s stallions, employees, veterinarians, or other animals in the care of DJRH whether or not caused by the owners horse.

 

13.  The breeder requires 48 hours’ advance notice when the Owner wishes to remove his mare(s) from the farm. Regular receiving and departure hours for visiting mares at 8am MST to 5pm MST.

 

 

14.  When the above named Mare Owner signs and returns one copy of this contract to the Breeder, it will then be a binding contract on both parties, subject to the terms and conditions. This contract is not valid unless complete in full.
